Petco is allegedly hiding credit checks and other consumer reports when hiring employees. Petco has been sued because they may not be clearly telling employees that it will be running employee background check or credit check. Why is This a Problem?
Petco’s application process doesn’t clearly state that a “full employee background check” or credit check will be conducted. This may be against the federal law called the FCRA (Fair Credit Reporting Act). The FCRA makes it illegal to run credit or employee background checks without fully telling someone and getting their consent before doing it. Petco did not do this in the clear way that the law requires.
Potential Class Action
This may be an FCRA violation because it is unfair to potential employees if they are not told what their rights are during the hiring process. Also, running an employee background check or credit check, without their consent, may be harmful to the potential employee. It may be an indicator to credit scoring companies that you have financial issues or need financial resources and these constant checks may affect your overall credit score.
