Design Defect
There are investigations which show that Samsung may be selling a top loading washing machine that contains very powerful motors and no agitators within the drum of the machine. However, the motors may simply be too powerful for the materials selected in the rest of the washing machine. The parts surrounding the motor, tub, and drum could be highly stressed and could frequently break down. It is reported that when the parts holding the wash drum in place become compromised, the wash drum becomes detached, and violently strikes the insides of the top loading washing machine. This includes the bracket that supports the discharge pump. This has resulted in a high number of complaints for problems with the “spin” cycles related to high vibrations, breaking springs, leaking water, and explosions related to the spin cycle. As a result of this design defect, these top loading washing machines can be unsafe, thus rendering them potentially defective and a safety risk for use in a consumer’s home.
A Manufacturer’s Responsibility
Generally, manufacturers have a duty to design, manufacture, produce, test, inspect, market, distribute and sell its products with reasonable care and in a workmanlike fashion. It can be argued that the products like top loading washing machines are expected to perform as a consumer expects it to perform. However, if a manufacturer chooses to conceal the defects of their products, they should be held responsible.
