Union Bank Begins Refund of Overdraft Fees

Union Bank Admits They May Have to Pay for Overdraft Charge Violations

Union Bank admits to a process of “resequencing”. Union Bank admitted that they returned the debits and charged overdraft fees for insufficient funds. This is against the law in several states. Many people have received a notice of a part of their refund. But there is more money that is available for refund. 

Union Bank likely engaged in “resequencing” checks so that checks for higher amounts were cleared first, causing checks for smaller amounts presented on the same day to bounce and cause customers to pay illegal overdraft fees.

Union Bank Did This Before

Union Bank was involved in illegally taking customer money in 2011. In that case, Union Bank paid a $35 million class action lawsuit settlement over its overdraft fee policy. They did not learn from that mistake and continued to take customers’ money through 2015.

There was a national class action called In Re Checking Account Overdraft Litigation. In that case where Union Bank paid $35 million, they were accused of manipulating the order of debit card transactions so they can deplete customers’ checking accounts and trigger overdraft fees.

Many banks were accused of this in the case In Re Checking Account Overdraft Litigation, including Bank of America which paid a $410 million class action settlement to resolve its portion of the case.
