Background
The timeshare company Hilton Grand Vacations has allegedly been making robocalls to phone numbers without obtaining the prior consent of the recipients. This problem first came to light when Telephone Science Corp. reported receiving 11,450 autodial robocalls. These calls were made to so-called “honeypot” phone numbers. The numbers were purposely created to lure robocallers in violation of the TCPA. Telephone Science Corp. set up a network of 200,000 phone numbers to detect and track robocalls. If true, this report shows that Hilton Grand Vacations has been making unsolicited robocalls. These 11,450 calls were just those that were reported by Telephone Science Corp. Hilton Grand Vacations may have made more unsolicited calls.
Hilton Grand Vacations Company is a subsidiary of Hilton Worldwide, a multinational hotel and hospitality company. Hilton Grand Vacations is a major seller of timeshares. Members jointly own resort villas for a limited period of time at many of Hilton’s resort locations.
The TCPA
TCPA stands for the Telephone Consumer Protection Act. It was created in 1991 to regulate phone solicitations and the use of automated telephone equipment. Since then, the law has been amended to include rules for text messages, cell phones, and fax machines.
The main rule is that it is illegal to make robocalls to people without first gaining their consent. Businesses that want to use autodialers and prerecorded/artificial voice messages have to obtain the prior written consent from consumers. Another major rule is that it is illegal to make robocalls to cell phones or any other service that charges the recipient for the call.
Potential Class Action
Telephone Science Corp. reports that Hilton Grand Vacations has been making robocalls to phone numbers without first obtaining the consent of the recipients. If these allegations are true, then Hilton Grand Vacations may have been making unsolicited robocalls to other phone numbers as well.
