While Yo Yummy product says that its product is 100% natural, it is anything but natural. Yo Yummy is being investigated for a class action based on falsely advertising Grade A natural ingredients. We are seeking to get Yo Yummy to change their advertising and stop any advertising that says the product is Grade A with all natural ingredients.
False Advertising
A product may be marketed or advertised incorrectly if it leads the consumer to believe it is substantially better than a competitor’s product and causes the consumer to purchase the incorrectly advertised product. False advertising of consumer products is unfair to both consumers and close competitors of the company that is falsely advertising. It can cause competitors to lose sales as well as change consumer opinions on the products they are thinking about purchasing.
In the Yo Yummy case, if a consumer purchases the yogurt thinking that it is Grade A, with all natural ingredients compared to a competitor, the consumer is likely to buy that product rather than another. However, anyone who purchases the product believing the false claims are generally paying a higher price and not getting anything better for the incorrectly advertised product.
Similar Class Actions
In another all natural case in New York, a plaintiff accused Stevia In The Raw maker Cumberland Packing Corp. of misleading customers by the “natural” claims listed on Stevia in the Raw sweetener packages. According to the Stevia class action lawsuit, the label clearly says that Stevia In The Raw is a “100% Natural Zero Calorie Sweetener” and the plaintiff consumer said she paid more because she believed it to be natural.
Stevia denied this. However, the Stevia In The Raw class action lawsuit states that Cumberland conceals from customers that ingredients dextrose and maltodextrin which are made from a chemical process, in part by stating that they are “natural carbohydrate[s].”
The plaintiff also alleged that by labeling the sugar substitute as “natural,” “all natural” or “100% natural,”
Stevia In The Raw manufacturer has “profited enormously.” The plaintiff also claimed that there were less expensive sweeteners available to customers but Class Members were paid extra for a “natural” product.
